Right of Withdrawal — DRAFT

DRAFT — Effective only once paid plans go live. During beta no paid services are offered; there is no payment obligation and therefore no statutory right of withdrawal in this sense.
1. Scope
Boncard addresses businesses (§ 14 BGB) exclusively. Businesses have no statutory right of withdrawal under §§ 312g, 355 BGB (which applies only to consumers).
Should paid plans accidentally be made available to consumers later, the following instruction applies to those consumers.
2. Right of withdrawal (consumer / B2C case)
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period expires fourteen days after contract conclusion.
To exercise the right of withdrawal, inform us:

by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not obligatory.
3. Effects of withdrawal
If you withdraw from this contract we will reimburse all payments received from you without delay and not later than fourteen days from the day on which we received your notification. Reimbursement uses the same means of payment as the original transaction.
If you requested that the service begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the service already provided up to the time of withdrawal notice.
4. Lapse of the right of withdrawal
The right of withdrawal lapses for service contracts once we have fully performed the service and only began performance after you gave express consent and acknowledged that you would lose your right of withdrawal upon full performance.
5. B2B clarification
Businesses cannot invoke or waive the statutory right of withdrawal because it is not granted to them by law. Contractual termination is governed by §9 AGB.
